WILLIAMSPORT – The Trump campaign organization has renewed its attempt to stop the commonwealth from certifying the results of the Nov. 3 presidential election.

Donald J. Trump for President Inc. and two voters Thursday filed a motion in U.S. Middle District Court for a temporary restraining order to prevent certifying the results of the “maladministered election.”

Delaying the certification process a short time will give the parties the opportunity to expeditiously determine the full extent of alleged violations and whether they were sufficient to cast the election’s outcome in doubt, they say.

The Trump organization accuses Commonwealth Secretary Kathy Boockvar and the election boards in seven counties of going out of their way to avoid complying with the state’s election laws.

The litigation cites generalized issues with mail-in ballots and vote-counting lacking the required observers.

The injunction request was just one of numerous developments in the case Thursday. Others include:

  • Judge Matthew W. Brann allowed the Democratic National Committee (DNC) and the American Civil Liberties Union (ACLU) of Pennsylvania to intervene as defendants but denied the request of Philadelphia lawyer Daniel A. Berger. The DNC and the ACLU contended the election boards in Allegheny, Centre, Chester, Delaware, Montgomery, Northampton and Philadelphia and Boockvar could not adequately represent their interests in opposing the Trump campaign’s claims of vote fraud. In denying Berger’s petition to intervene, Brann found his interests are not substantially different from the private individuals represented by the ACLU.
  • The seven election boards and Boockvar filed motions to dismiss the complaint of the Trump organization and David John Henry of Lancaster County and Lawrence Roberts of Uniontown.
  • The DNC did likewise, claiming Commonwealth Court has exclusive jurisdiction over presidential election contests. It also argued state law makes it clear mere irregularities or general grievances are insufficient to overturn an election result. The DNC pointed out the Trump people waited until after Joe Biden was declared the winner in Pennsylvania before raising an issue about some mail-in voters prior to the election being given the opportunity to cure deficiencies with their ballots.
  • The state Senate Republican Caucus sought permission to intervene on behalf of the Trump organization.
  • Several Republicans, including former U.S. Reps. Charles W. Dent and Jim Greenwood, asked permission to file a friend of the court brief in support the defendants' motion to dismiss. They argue state court where there also are challenges to the election is the proper venue for issues raised in this case.

Finally, the commonwealth asked Brann not to consolidate a similar suit of four voters against Gov. Tom Wolf and Boockvar with the one filed by the Trump organization.

The state claims the three voters from Centre County and one from Montour County do not have standing, pointing out they do not allege they were prevented from voting or that their votes were rejected.

The thrust of the suit by LaMarr Pirkle, Theodore Dannerth, Lauren Danks and Casey Flynn is that their votes were diluted by ballots cast illegally.
