The Pennsylvania Supreme Court has dismissed a case brought by U.S. Rep. Mike Kelly, R-Butler County, who unsuccessfully argued that Pennsylvania’s mail-in ballot provisions violate provisions of the state constitution.

The justices, in a 5-2 decision, ruled Kelly’s challenge should have been brought before the state ran primary and general elections with the new procedure. The law allowing wider voting by mail was enacted in 2019 and used for the first time in this year’s primary and general elections.

Dissenters Thomas Saylor and Sally Mundy, the two Republicans on the seven-member court, felt the case should be heard on its merits, but they concurred with the majority in saying that even they would not be willing to set aside this year’s results since the campaign had fully played out under the new rules.

The decision was the latest in a strong of defeats for President Donald J. Trump’s efforts to overturn vote returns in key swing states that gave the American presidential election to former Vice President and Democratic Party nominee Joseph R. Biden.

According to Pennsylvania’s unofficial, final tally, Biden defeated President Donald J, Trump by 81,660 votes: 3,459,923 to 3,378,263. That a margin of 50.02 percent to 48.84 percent, with the rest of the votes going to Libertarian Party nominee Jo Jorgensen.

Gov. Tom Wolf certified the result Tuesday, giving Biden the state’s 20 electoral college votes when they are tallied next month.

Republican and Democratic lawmakers approved the legislation to allow voters to cast ballots by mail; until this year, voters had to request absentee ballots and explain why they couldn’t get to the polls. Wolf signed the mail ballot law last year.

About 2.6 million voters cast ballots by mail in the general election. State and local officials have repeated defended the integrity of the election.
