STATEN ISLAND, N.Y. -- While the race for the 2020 presidential election was called by various media outlets four days after Election day announcing former Vice President Joe Biden and Sen. Kamala Harris as the winners, the official certification of the results might take a little longer.

With President Donald Trump fighting the election results, Biden was announced the winner on Saturday afternoon when he won Pennsylvania, a battleground state, based on a call from the Associated Press.

With Biden winning Pennsylvania, he accumulated more than the 270 Electoral College votes needed to win the presidential election. By the end of Saturday, Biden had an insurmountable lead with 290 Electoral College votes, according to the Associated Press. He won in Nevada soon after the Pennsylvania results were in, giving him 290 electoral votes. The votes in Georgia, where Biden leads by at least 7,000 votes, are being recounted. If Biden wins Georgia, he would finish with 306 electoral votes.

But just hours after Biden claimed victory, Trump said Biden was “rushing to falsely pose as the winner.” In a statement released Saturday, Trump said Biden “has not been certified the winner of any states.”

HOW IS THE ELECTION CERTIFIED?

Election results are finalized through two processes: canvassing and certification, according to Ballotpedia.com.

“Canvassing generally refers to how state and local officials confirm the validity of ballots cast in an election. Certification is the process authorities use to formalize the election results based on the canvass. However, some states, localities, and commentators use the terms interchangeably to describe the entire process of counting ballots and formalizing results,” said Ballotpedia.com on its website.

However, each state has its own laws about when an election is certified.

According to Ballotpedia.com:

  • The certification deadline in six states is within one week of the election.
  • In 26 states and the District of Columbia, the certification deadline is between Nov. 10 and Nov. 30.
  • In 14 states, the certification deadline is in December.
  • Four states (Hawaii, New Hampshire, Rhode Island, and Tennessee) do not have statutory deadlines for results certification.

WHAT ABOUT RECOUNT LAWS?

A recount is when election results “are re-tabulated to verify the accuracy of the original results,” according to Ballotpedia.com. Some states allow recounts to occur after canvasing, but usually before results are made through official certification, the website said.

“Recount laws vary by state, but the two most common types of recounts are automatically triggered and requested. In 20 states, results within a certain margin of victory automatically trigger a recount process. In 43 states, candidates, political parties, and voters (varies by state) may request a recount. In the event that a recount occurs, the effects of the election are put on hold until the recount is resolved,” said Ballotpedia.com.
